Today I got an email from Rob Parassi:
"I am the writer/owner, producer, lead singer of the song Play That Funky Music. You have no sync license or authorization to use or alter either mine, or any member of the band's likeness, nor do you have a mechanical license to use the audio. Therefore, you must remove that video or you'll be reported to both YouTube, and also the attorney that does the administration for my publishing company. I don't mind bands or individuals doing the song or posting it in a karaoke fashion, but to alter the original recording or any of our video performances is not acceptable.

Mashup is actually produced by DJ earworm, I have edited a verse of the song and also produced the video. Video is cut so that it looks like that the wild cherry is playing at a gay club. Maybe Rob has serious stroke of gayphobia! There is million of other versions of that song in youtube :D
Well, I dont care if he wants to sue me. Watch the video while you can. Actually it has been a very popular video when I have played it at local clubs.

i think i'll take the side of the band on this one. this was a good video remix. but does it have to slant in that direction?

Haha, I think the problem is that the audio (and the video too) are very well produced!
So if you were just a casual listener and didn't know either song, you might think that was the original version! I guess that's probably what the guy is worried about- people seeing that and thinking that wild cherry are in some way associated with frankie goes to hollywood or that they are a band that plays in gay clubs.

Well as a DJ ... I have to side with us DJ's on this. This is what we do. We mix, remix, blend, mash-up, and do whatever we need to do to "update" songs to make a more danceable or up to date version or just change it up beacause quite honestly the "same old same old" gets BORING !! Songwriters and copyright people are greedy, pathetic, and ridiculous at times. Keep doing what you're doing bro !! Great beat and mix on the video. I know DJ Earworm and he does AMAZING mash-ups !! BUT .... unfortunitely it is HIS music so you're prolly gonna have to remove it from Youtube but it doesn't mean you have to stop making them. It's not 1976 anymore Rob Perassi ...lol. It's a whole new modern world with tons of new technology !! But I do understand ... it's his ONLY hit afterall ... lol. It would be FUNNY if he was in a club dancing and that video played ...lol. LMAO !!

Sounds more like the record company's layer talking than the real Rob Perassi. Even if he is the real deal, he should be happy that someone still appriciates his old production enough to recycle it - thus bringing him free publicity.
It sickens me to see how the protectionistic old generation refuses to understand how everyone is not in it for the money. Creating, re-creating and sharing is fun.

I understand how us DJs find the attitude from musicians a bit strange but they are coming from a different viewpoint.
I'm a musician too, so I have heard what they say (but I don't agree with it)
When speaking amongst themselves they say.
"We hate DJs. They just play music and make money from our hard work and talent. Why don't they learn to play an instrument! They haven't paid their dues like we have. Why don't they write their own songs and then mess them up if they want to.
DJs just take the bread out of the mouths of real musicians because they work cheaper and just play records, so musicians get less gigs."
As a DJ who has also been a performing musician I don't agree with this I think it is outdated and narrow minded.
I think every performing musician should serve their time as a working dj so that they can learn how to please a crowd and not patronise them with the same old boring bulls**t After all, most of them play a lot of covers, which is no different than DJing. In fact it's worse than DJing, because their versions are often much worse than the original.

Agreed... But what about radio DJ's of course without them they wouldn't get the 'air time' and 'exposure' they need to 'sell' their records.
All I am doing is offering an artist or band 'club time' which gives them 'exposure' which helps them 'sell' their music!

I'm with you. Without DJs playing tracks how would bands ever sell there music.
Plus which the boundary between DJ and musician is very blurred now We all add creativity to the music we promote with FX, sampling, cutting, looping, mashing and all the other things we do now. Look at how different different mixes are by different DJs.
I think it is legit to create humour with an old tracks. After all, I bet this could give them some of the best publicity they've had in years.

Unfortuanatley it is the lawyers and a little thing called "precident in copywrite protection". I fthey do not make an effort to protect their copywrite material whenever they know about a violation it will severely weaken their case when there is a TRUE violation of copywrite such as someone illegally selling there original video/audio. If they don't show the precedent that they do aggressively attempt to protect that copywrite in ALL instances some botton feeding lawyer will use this against them in a legitament suit....unfortuanatley our stupid judges and juries are not smart enough to determine on their own when a case is legit and when it is not and they always fall back upon technicallities, loopholes and precidents no matter how flimsy or unrelated.
Bottom line, don;t blame the musicians, blame the lawyers, the courts and the screwed up copywrite laws.

does anybody care if someone steals one of your best mixes, do a little edit and play it on the radio and claim it's his? this happens to me all the time. i don't own any of the music so i don't care. guys make a lot of money playing other peoples mixes. but if a law firm told me to stop playing thier music, i would respect thier wises and use another song. i don't think it's worth the risk to play around in that grey area.
